Enduring Power of Attorney
An Enduring Power of Attorney is a legal document whereby you (the ‘donor’) can appoint Attorneys to look after your affairs during your lifetime should you become mentally incapable of managing your own affairs.
As Donor, you can specify whether the Attorneys will be given power to deal with all aspects of your affairs, or personal care decisions only, should the need arise.
Only in the event that a Donor’s medical doctor certifies that the Donor has become incapable of looking after their own affairs can the Attorneys make an application to the High Court to register the Enduring Power of Attorney thereby activating it and giving it a formal legal standing. Otherwise the Enduring Power of Attorney document remains dormant i.e. without formal legal effect.
Frequently, Enduring Powers of Attorney are created but the need to proceed to register them does not arise. Nonetheless, the creation of an Enduring Power of Attorney will provide you with the reassurance that your affairs will be managed by the person / persons of your choosing in the event that you become unfit to manage your own affairs.
